Yakamoz End User Licence Agreement (EULA)
Draft — pending legal review.
Version: 1.0.0
1. Parties
This agreement is between the person installing or using the software ("You") and Swiip, the publisher ("We"; swiip.app). The software is called Yakamoz (the "Software"). By installing or using it you accept this agreement.
2. Licence
2.1. We grant You a non-exclusive, non-transferable, non-sublicensable licence to use the Software personally on your own computers.
2.2. The Software does not enforce a device count; the licence is based on trust. It covers your own computers. Computers owned by others or shared by an organisation need their own licence.
2.3. The Software is licensed, not sold. All rights in the Software and the brand remain with Us.
3. Trial
3.1. The Software can be tried with all features for 14 days from first installation.
3.2. When the trial ends, the Software restores Windows to normal (your taskbar returns) and offers only "Enter licence / Buy / Uninstall". No other feature works until a licence is entered.
3.3. Trying the Software requires no account and no payment details.
4. Licence key and updates
4.1. Buying is not open yet. When sales open, the licence will be issued after purchase and verified offline; it contains no name or e-mail. Details of the sale (payment provider, tax display) will be announced on these pages when sales open.
4.2. Updates within the 1.x line are free of charge. Later major versions (2.0 and above) may be priced separately.
4.3. The update check is asked during setup; no update is installed without your approval.
5. Restrictions
You may not: (a) sell, rent, lend or transfer the Software, or share the licence key; (b) break, bypass or remove licence verification; (c) reverse engineer or decompile the Software except to the extent mandatory law permits; (d) use the Software for unlawful purposes.
6. System changes and undo
At your request, the Software changes Windows settings (registry, taskbar state, start-up entries, and so on). Every change is first written to a ledger with its old value and can be undone. Uninstalling is designed to return the computer to its pre-install state. We do our best to ensure that; backing up your computer is your responsibility.
7. Privacy
The Software collects no telemetry. Details are in the Privacy Policy and the KVKK Notice; they are not part of this agreement but should be read with it.
8. Refunds
The refund terms that will apply once buying opens are in the Refund Policy. This does not affect your statutory consumer rights.
9. Disclaimer
To the extent permitted by law, the Software is provided "as is". We do not guarantee that it will work with every future Windows update or with third-party software.
10. Limitation of liability
10.1. To the maximum extent permitted by law, We are not liable for indirect damages, or for loss of data, profit or opportunity arising from the Software.
10.2. Our total liability is limited to the price you paid for the Software.
10.3. This limit does not apply to intent, gross negligence, injury to life or body, or any liability that cannot be limited by law.
10.4. Your statutory consumer rights (in particular under Turkish Consumer Law no. 6502 and the mandatory rules of your country of residence) are not limited by this agreement.
11. Termination
If you breach this agreement your licence may end. You must then uninstall the Software (Settings › Apps).
12. Third-party components
The Software contains open-source components; their licences are in the "Third-Party Notices" document.
13. Changes
We may update this agreement for future versions; the text you accepted remains valid for the version you installed.
14. Governing law and jurisdiction
This agreement is governed by the laws of Türkiye. The courts and enforcement offices competent by law have jurisdiction. If you are a consumer, the courts and arbitration boards competent by law, and the mandatory consumer protection rules of your country of residence, are preserved.
